    Personal Injury Claims

Personal Injury litigation deals with claims where you have been in an accident or had a personal injury that was not your fault, but can include many other types of personal injury claims.

    Medical Negligence Claims

Dealing with a Medical Negligence claim can be very stressful for you and your family. One of our medical negligence solicitors will help this time to run smoothly and get you adequate compensation.

    Road Traffic Accidents

Rad traffic accidents are extremely common in Ireland. When you are involved in a car crash that was not your fault, you may be able to make a compensation claim for any injuries and expenses, such as covering medical expenses, loss of income or repairs to damages on your car.

    Accident in a Public Place

Public liability claims (usually due to slips, trips and falls) can happen in any public place. The most common examples are a fall due to a slippery floor in a supermarket, tripping on broken or uneven pavement, tripping due to obstacles such as exposed cables or slips or trips at work.

    Workplace Accident Claims

Your employer has a strict legal duty to provide you with a safe working environment, and proper safety gear and equipment to carry out your work. If you have been injured at work in a workplace accident that was not your fault, you may be entitled to compensation for your injury or loss of earnings.

    Holiday Accident Claims

A holiday should be a relaxing time with your family and friends. However, if you have an accident or suffer a personal injury due to someone else’s negligence while on holidays abroad or in Ireland, it can be extremely expensive and stressful and you may be eligible to make a holiday accident claim and receive compensation* for your personal injuries.

Commonly Asked Personal Injury Claims Questions

How long do I have to make a Personal Injury Claim?

In most cases, you have two years from the date of the accident to make your claim or two years from the date of knowledge of the damages connected to the accident. If you are outside of this time, you will be barred by the Statute of Limitation Act from bringing your claim. However, in certain cases there are exceptions to this rule.

For more information, visit our Personal Injury Claims page or contact one of our Personal Injury Solicitors now.

What is the Injuries Board (PIAB)?

The Personal Injuries Assessment Board (PIAB) also known as the Injuries Board, is the Board that has been established by the Government to see if certain claims can be dealt with by way of assessment without having to go to Court. All cases must go through the Injuries Board before they can go to Court.

First, we approach the other side, or their Insurance Company, to make an offer. If they do not make an offer, or if the offer is unacceptable, we will then bring your application to the Injuries Board.

We will bring the necessary Application to the Injuries Board on your behalf and deal with all matters that arise in connection with same. If the Injuries Board process is unsuccessful, or no settlement is made, we then bring your personal injury claim to court.

How much compensation can I get?

The amount of personal injury compensation you can be awarded depends on several factors, including pain and suffering experienced, financial loss, how your lifestyle is effected after the accident and the seriousness of the injury. The compensation for your personal injury claim, known as general damages, will be awarded based on medical evidence.

For more information on how much compensation you can claim for a personal injury, visit our Personal Injury Claims page or contact one of our Personal Injury Solicitors now.

Do I need a personal injury solicitor?

In certain cases after an accident or personal injury has occurred, a victim will be put under pressure to accept a lower settlement, or will be told they do not need a solicitor. However, a specialist personal injury solicitor will represent your best needs, and help you get the best possible claim. The Injuries Board is also encouraging claimants to apply without the services of a solicitor. However, a personal injury solicitor will also help you to get the best possible and fairest claim. The Central Bank, has also declared that personal injury solicitors will get higher value settlements than when a person self-represents.

How do I make a personal injury Claim?

All personal injury claims (with the exception of medical negligence claims) must in the first instance be referred to the Injuries Board. This can be a difficult process especially if you are not familiar with it. Ferrys Solicitors LLP Personal Injury and Accident Solicitors will provide you with the assistance and guidance required in making this application and we will seek the best resolution for you along with the compensation you deserve. If the matter is not resolved through the Injuries Board process, we will make any subsequent applications to Court on your behalf. We will use our expertise to ensure you are properly compensated and make the process as simple as possible for you.
