If you search for Irish solicitors based on “No win no fee solicitors”, “nowinnofee”, “no foal no fee” or “no fee litigation” you will find many websites advertising on this basis. However, it is strictly prohibited for Irish solicitors to advertise based on no win no fee, by the Law Society of Ireland, who govern the standards Irish solicitors must operate under.

What does no win no fee mean?

When solicitors take on a case based on “no win no fee” or “no foal no fee”, it means you will not be charged a fee by your solicitor if you do not win your case. However, many claimants mistakenly believe they will incur no fees if their case is not successful. Often, the claimant is still liable for their own medical report fees and/ or the Defendant’s costs.

No win no fee agreements are used by many clients, as they may not otherwise be able to afford the fees needed to take on their case.

Are no win no fee agreements legal?

No win no fee agreements are completely legal. The Law Society only states that solicitors and solicitor firms may not advertise themselves based on the idea of “No Win No Fee”. It is common for many solicitor firms to take on personal injury claims on a no win no fee basis.

Some of the websites you find advertising in this way may be in breach of the proper standards of the Law Society of Ireland, or are in fact claims harvesting websites. These claims harvesting websites that advertise based on no win no fee litigation may not be solicitors firms and may be operated outside of Ireland. So if you share the details of your claim with them, it may not be shared with an Irish personal injury solicitor.

Irish solicitor firms who advertise based on “no-win-no-fee” are not complying with their professional obligations to the Law Society of Ireland.
