    Can I make a No Win No Fee Claim?

    If you search for Irish solicitors online based on “No win no fee”, “nowinnofee” or “no fee litigation” you will find dozens of websites advertising on this basis. However, the Law Society of Ireland, who govern the correct practice among Irish Solicitors, have strict rules prohibiting advertising based on “No Win No Fee”. Most of the websites you find advertising in this way are in breach of the proper standards of the Law Society of Ireland, or are in fact claims harvesting websites.

    These claims harvesting websites that advertise based on no win no fee litigation, are not proper solicitor firms and may be operated outside of Ireland. So if you share the details of your personal injury claim with them, it may not be shared with a personal injury solicitor.

    How long do I have to make a Personal Injury Claim?

    If you have been involved in an accident and wish to make a personal injuries claim, you must be within the allowed time period. This is defined by the Statute of Limitations for personal injury compensation claims in Ireland.

    In most cases, you have two years from the date of the accident to make your claim or two years from the date of knowledge of the damages connected to the accident. If you are outside of this time, you will be barred by the Statute of Limitation Act from bringing your claim.

    Exceptions to the two year rule

    In several specific examples, there is an exception to the two year rule for personal injury claims. For example, for a minor the date of knowledge is when the minor turns eighteen years of age. A minor can also pursue a claim prior to their 18th birthday. Other exceptions include industrial diseases acquired over time and asbestos related injuries.
