Schoolboy awarded €21,000 in damages

A 10-year-old schoolboy, who was represented by a personal injury solicitor from Ferrys Solicitors LLP was awarded €21,000 damages in the Circuit Civil Court.

Antonio Bozkaya, who is now 11 years old, struck his head against “an S hook” in a sports creche and suffered an injury to his head and neck. The boy, through his mother, Danielle Bozkaya of Aston Village, Drogheda, Co Louth, sued Michael Nugent Tennis Academy Limited, trading as Nzone at Posey Row, Kinsealy, Dublin.

Barrister Grainne Larkin appeared with Gillian Browne of Ferrys Solicitors LLP, Artane. Ms Larkin told Circuit Court President, Mr Justice Raymond Groarke that Antonio had been playing in the play area when he stood up and struck his head on the metal “S” hook which had not been covered with any protective padding.

Antonia suffered a laceration to his forehead and a soft tissue injury to his neck before he was brought to Our Lady of Lourdes Hospital, Drogheda, where the wound was cleaned and glued. He later received two sessions of physiotherapy after complaining to his GP of neck pain.

Antonio was left with a small permanent scar, which is mainly hidden within his hairline. Ms Larkin told the court the defendant had made a settlement offer of €21,000 which she was recommending to the court. Judge Groarke said it was a good offer and approved the settlement.
